HC holds Mishra, students guilty of cheating

NAGPUR: The Nagpur bench of Bombay high court has held Sunil Mishra, one of the prime accused in Nagpur University’s infamous fake marksheet and
revaluation scam and two other beneficiary students guilty of cheating. However, it acquitted kingpin Yadav Kohchade and his accomplice Ashok Jawlekar from all the cases. Scrutinier Madhukar Smarth was acquitted in one case and convicted in another. A single-judge bench of justice Ravindra Chavan quashed all the charges levelled against Mishra, Mahendra Gote and Parag Fadnavis for which they were convicted by the special court of second additional chief judicial magistrate Ashok Gattani last year. The bench provided them further respite by stating that the sentences these accused had undergone so far were sufficient and hence should be set free. While pronouncing verdict in Gote’s case, the court observed that his conviction would eclipse his career as a lawyer. The judge directed the university to return his degree and also asked Nagpur University and Bar Council of Maharashtra to take appropriate steps stating that “cancelling degrees is beyond scope of powers of learned magistrate.” In case of Gote, he failed in seven subjects while appearing in his final year law examination in 1996. He applied for revaluation and managed to pass the examination allegedly in connivance with Kohchade and Smarth using fraudulent means. In case of Fadnavis, a first year engineering student, failed in mathematics during winter 1996 exam. However allegedly conniving with Kohchade and Jawlekar, he managed to clear the subject by tampering marks. According to Kohchade’s counsel Prakash Naidu, this is third acquittal for his client in a week. On Tuesday, the high court had acquitted Kohchade in the case of beneficiary student Anil Gupta, while he was convicted in the case of Laxmikant Zade along with scrutinier Prabhakar Hejib. Their sentences were also reduced from twelve and half years to five and half years. Moreover, former dean of engineering Hemant Thakre, scrutiniers Smarth and Shyam Kalamkar along with beneficiary students Rajendra Yadav, Mohammed Ishaq and Shailesh Tupkari were absolved of all charges by the court. Kohchade would be moving to the Supreme Court against high court verdict.

Nagpur varsity to send its envoy to Bihar

NAGPUR: The Nagpur University's management council has decided to send its emissary to Bihar to verify complaints of some students that degrees
they
had obtained from the university were blacklisted by the Bihar government and as a result they had been refused jobs. The council's decision came after the Bharatiya Janta Yuva Morcha (BJYM) activists staged demonstrations in front of the university on Friday and tried to burn vice chancellor S N Pathan's effigy alleging administration's failure to secure top grade from National Assessment and Accreditation Council (NAAC) and to protest against Bihar government's decision to blacklist Nagpur University's degrees. The council has unanimously decided to send member Nirmal Singh to Patna for verifying the facts and clear the confusion. When contacted, Singh confirmed that the decision has been taken to send him to Bihar, but "he had not yet receive a letter from the university registrar." He declined to make further comments. The university sources informed that there are chances of miscommunication between the Nagpur University and other institutions in Bihar as the former writes ‘Nagpur Vidyapeeth' on its degree certificates but in northern states, the degrees are not recognised because the ‘Vidyapeeth' word is in Marathi and in these states, they refer university as 'Vishwavidyalaya'. When contacted the VC's office, officials there informed that Pathan had gone to Pune for treatment of jaundice.

No immediate split of Pune University

PUNE: Though the growing size of University of Pune (UoP) is a subject of contention, immediate bifurcation of the varsity is not on cards, confirmed sources in the higher education department on Thursday. A proposal to carve out a separate varsity for two tribal districts from the Nagpur University is however awaiting the government approval, sources said.
Sources have put to rest contradictory reports about the possibility of immediate split of UoP on account of its size. When asked if any committee was formed to decide on bifurcation of UoP, principal secretary of Higher and Technical Education J S Saharia on Thursday said, “I have not heard of any such committee. Certainly, not to my knowledge.”
Earlier, on a recent visit to the city, he had maintained that though National Knowledge Commission had recommended formation of new smaller universities to lift the Gross Enrolment Ratio, the idea got stuck at availability of funds, land and brand images of big universities.
A top source in higher education department said, “If we bifurcate UoP, new university should come up at either Ahmednagar or Nashik. Formation of a varsity needs at least Rs 300 crore, which is not feasible. In case of bifurcation, UoP will not be ready to part with its reserve funds, which are close to Rs 300 crore. Besides, college students in Nagar and Nashik might be reluctant to lose the brand image and funds of Pune University.”
When asked if Pune, Mumbai and Nagpur varsities had become unmanageable due to the large number of affiliated colleges, source said, “As bifurcation is not possible in near future, UoP should strengthen Nagar and Nashik sub-centres on priority basis. Mumbai University is a fit case for division. A separate university for Konkan is must.”
The higher education department has recommended formation of a university for tribal districts of Chandrapur and Gadchiroli, to be named Gondwana University.

Violent Parishad at Nagpur University

Nagpur, Feb 20: The activists of the BJP’s student wing ABVP went on a rampage on Friday and damaged the Nagpur University premises after five students belonging to a minority were denied admission to the institution.

has suspended the ABVP activists involved in the incident. The ABVP activists shouted slogans against the University authorities and went on a rampage damaging the property and several vehicles. The students demanded the authorities to restore the admission of the five students but their pleas went unheeded. Speaking to a TV news channel, Dr. S N Pathan VC Nagpur University said that an FIR has been lodged against the ABVP students. He also assured of a proper inquiry into the matter.

Varsity should claim damages from BJYM

NAGPUR: After Friday's vandalising of Nagpur University by over 100 activists of Bharatiya Janata Yuva Morcha (BJYM), the legal fraternity has
suggested to the university bosses to demand compensation from organisation for damaging public property and denting the reputation of eight-decade-old institution. According to high court lawyer Firdos Mirza, all the party activists should be slapped with Maharashtra Control of Organised Crime Act (MCOCA) for attacking a national heritage structure more than once. “It's nothing but sheer conspiracy that the hooligans repeatedly attack the same public property. It is unfortunate that neither the university administration nor the police are taking stringent steps to prevent recurrence of such acts,” he lamented. Mirza that the hoodlums should also be arrested under Sections 353 of the IPC for deterring a public servant from discharging duties and creating a sense of fear in his mind. Mirza informed that the apex court in one of its verdicts in 2007 had mentioned about recovering compensation from those who damaged the public property. Moreover, the Maharashtra government has also framed an ordinance to recover amount from hooligans who torched the public property after activists of Maharashtra Navnirman Sena (MNS) unleashed a reign of terror against north Indians. “In Friday's incident, the university has full right to demand payment for damages from the culprits,” he said. Anand Parchure, another lawyer, while severely criticising the Friday's incident said, “Who gave them the right to take law in own hands? They deserve maximum punishment and university authorities should recover maximum compensation from the organisation.”

Nagpur University building vandalised by students

Nagpur (IANS): The office of Nagpur University pro-vice chancellor was vandalised and parts of the main building were set ablaze allegedly by the acitivists of Bharatiya Janata Yuva Morcha who were protesting cancellation of admissions of five students.
Subhash Belsare, registrar of the university, told IANS that apart from the varsity premises, chamber fittings and official car of pro-vice chancellor G.S. Parasher were also vandalised.
"The tentative estimate of the damage is over one million rupees," he said.
Belsare said a large group of people descended on the campus shortly after noon and started ransacking the university properties and damaging the offices of the top functionaries.
"We were taken by complete surprise. There was no notice, no discussions about their alleged grievances. They simply resorted to violence," he said.
University vice-chancellor S.N. Pathan said, "The attackers tried to set the main building on fire but were chased away by the security."
The university earlier deemed as irregular the admissions of a group of five students of Bachelor of Fine Arts course.
Belsare said that since the students did not fulfil the admissions criteria, their results were withheld and even the Bombay High Court's Nagpur Bench had dismissed their plea challenging the university move.
The university had been at the receiving end after it declined permission to the Bharatiya Janata Party to hold its two-day national executive committee meeting in the campus earlier this month.
