HC issues contempt notices against rly officials

The Nagpur bench of Bombay high court has issued contempt notices to two railway officials for disobeying court orders while hearing a contempt petition filed by the Central Railway Divisional Office Employees Consumer Cooperative Society, Nagpur.

Justice R K Deshpande had on February 2 issued notices to respondent Shailendra Jaiswal, additional divisional railway manager (ADRM), and senior divisional personnel officer (SrDPO) B M Shikare.

The petition was filed, on January 6, against stopping deduction of amount from the salary of the society's members. The society has a membership base of 6,000.

On September 5, 2007, the Central Railways had ordered closure of the consumer society with immediate effect owing to mismanagement. This order was challenged by the society president and secretary pleading that if mismanagement was done by a few persons, action can be taken against them but why put an end to the very existence of the society.

On September 19, 2007, justices A H Joshi and R C Chavan had stayed the railway order to close down the society. In the order it made it clear that the railways being unmindful, took the decision in haste and without observing basic principles of natural justice. Despite HC order, the railways unambiguously went ahead with the closure of the society and stopped deductions from the salaries of the members.

Despite repeated requests by the petitioner-society, the Central Railways is unmoved such that the society was forced to file a contempt petition.

Meanwhile, Chandrapur MP Hansraj Ahir, on January 22 has written to minister of state for railways K H Muniyappa asking him to ensure smooth functioning of the society. He has also demanded action against the railway officials who are not cooperating with the administrator appointed for the society.
