Moghe to decide on NIT, APMC dispute

The Nagpur Improvement Trust (NIT) are peeved over Congress leaders' intervention in its dispute with Nagpur agricultural produce marking committee (APMC). The NIT is trying to oust APMC from the land belonging to it located behind Ganeshpeth bus station. APMC's office is located on the spot, which NIT had partially demolished on Friday.

The NIT officials told TOI that they would refer the dispute to guardian minister Shivajirao Moghe and would accept his decision. The APMC officials had also shown readiness to accept Moghe's intervention. The minister would be able to convene a meeting on this issue only after the budget session of state legislature was over, they said. The officials further said that they had also talked to agriculture minister Radhakrishna Vikhe-Patil to resolve the dispute.

The civic agency's version on this dispute is diametrically opposite from that of the APMC. The NIT officials claimed that they could lodge a police complaint against APMC under Section 52 of Maharashtra Regional and Town Planning (MRTP) Act for illegally occupying their premises. "NIT had leased the land to NMC, which in turn leased it to APMC some 40 years ago. This is illegal. However, at that time land was not a big issue. Even though the land is reserved for a market, APMC has only constructed an office there. The land is thus not being used for the designated purpose.

"APMC had filed a writ petition against NIT in high court but had to withdraw it. It had committed that it would approach the NIT for resolving the dispute. When HC doesn't support their stand how can they justify it," a senior official asked.

Congress leaders including Nana Gawande, Dwarka Prasad Kakani and others had lodged a police complaint against NIT over Friday's demolition.

The NIT officials further said that APMC was unnecessarily creating a controversy. "APMC has a 3,000 sq ft office. We had told them that we would redevelop the building and give them an equivalent floor space. In addition we will build a low-end market, a budget hotel and a multi-level parking."

Officials further said that there was acute shortage of parking space in Ganeshpeth area, which could only be addressed by redeveloping the APMC office site. "They are creating traffic congestion in Ganeshpeth due to their adamant attitude," the official said.
