nagpur :- SC to hear headless colleges plea on Monday

In some bad news for the colleges operating without regular principals/directors in Maharashtra, the Supreme Court would be hearing some special leave petitions (SLPs) on Monday. If the apex court pronounces any order, it would make or break the career of lakhs of students studying across Maharashtra.

Lawyer for the original petitioners — KJ Somaiyya group and other colleges — Sanjay Kharde confirmed the development to TOI from Delhi. He said some SLPs on the issue were listed for Monday but they will appeal to the judges to club all the petitions and hear them at a later date. "Nothing can be said till actual hearing takes place," he said.

According to sources, nearly 1,000 colleges in the state till date had neither appointed full-time heads nor sought relief from any court. Shockingly, a majority of them also admitted the students without parent universities` consent. After missives from the court and the government, the universities took tough stance and banned their first year admissions from 2010-11. Even exam forms of their students were not accepted.

In case of Nagpur University, 457 colleges are still operating without regular principals/directors, leading to severe degradation of the quality of education and administration. These colleges have been split into two lists. The first one contains 341 colleges which were black-listed by NU while banning their first year admissions. Remaining 116 colleges had sought extension of six months from either the Supreme Court or high court for appointing full time heads and were permitted to conduct their first year admissions.

The trouble started when the Nagpur bench of Bombay high court comprising Justice BH Marlapalle and Justice Ambadas Joshi, in a landmark verdict on a suo motu PIL dated December 3, 2008, directed the state government and the universities to take steps to ensure that the posts of principals/directors in all private colleges are filled up before May 31, 2009. On this KJ Somaiyya and others moved the apex court where a vacation bench of justices Markandey Katju and Deepak Verma granted an interim relief. Another SC bench of former chief justice KG Balakrishnan and justice P Sathasivam on June 17 last year allowed the 2009-10 admissions for such colleges.

Since the relief was limited to the petitioners, many other colleges moved SC and Nagpur bench. The state later came out with a GR dated January 31 warning the colleges to appoint full-time principals/directors and even the lecturers as per court`s orders. Subsequently, more colleges filed SLPs which were heard by a vacation bench of Justice RM Lodha and Justice AK Patnaik on June 28. The judges granted additional six months to appoint heads which will end on December this year. However, the court had asked the colleges to inform about steps taken to fill up the posts and its hearing was scheduled on Monday.
