Govt to set up CBI courts at Pune, Nagpur and Amravati

The state department of law and judiciary has issued a notification constituting three special courts in Pune, Nagpur and Amravati, dedicated to conduct day-to-day trials of corruption cases registered by the Central Bureau of Investigation (CBI).

The department has issued a notification appointing special judges S V Lathkar, A S Shivankar and S M Shinde of the district and sessions courts in Pune, Nagpur and Amravati on March 30. The notification issued by the joint secretary S S Shinde states that the special courts will cover cases of Pune, Nagpur and Amravati districts.

CBI officials requesting anonymity said that the notification was not clear as the courts will not try cases of their entire jurisdiction, for instance its unit in Pune covers Western Maharashtra and Marathwada region. The Western Maharashtra covers districts like Pune, Sangli, Satara, Kolhapur and Solapur and Marathwada region covers district like Aurangabad, Jalna, Beed, Osmanabad and Ahmednagar.

The CBI feels that the notification is required to be corrected so that they can attend the court proceedings at one particular place instead of handling cases at different districts.

Vijay Achliya, principal secretary of the state department of law and judiciary on Thursday told TOI that the state government has taken a policy decision to set up courts only at places where there are sufficient numbers of CBI cases.

Achliya said the trial in cases outside Pune, Nagpur and Amravati districts will be conducted by the concerned district and sessions courts as the number of CBI cases is fewer.

CBI deputy inspector general of police Pravin Salunkhe said the government has constituted seven courts for trying CBI cases in Mumbai alone while the three new courts at Pune, Nagpur and Amravati will conduct cases of the concerned districts.

According to Salunkhe, the special court was earlier conducting cases of the state anti-corruption bureau and the CBI, but now the cases filed by the agency will be transferred to the new courts for expediting trial in corruption cases.

The cases outside Pune, Nagpur and Amravati districts will be conducted by the concerned sessions courts as they are also empowered to conduct trial under the Prevention of Corruption Act, Salunkhe added.

A year-and half ago, the agency had moved a proposal before the Prime Minister seeking, among other things, setting up of special courts for expeditious trial of cases investigated by the CBI.

Responding to the proposal, PM Manmohan Singh had announced the move to set up 71 special courts for CBI cases in the country. Of these, six special courts were sanctioned for Maharashtra in 2009 - three in Mumbai and one each in Pune, Nagpur and Amravati.

According to figures released in the Lok Sabha by V Narayanasamy, Union minister of state for personnel, public grievances and pensions, Maharashtra accounts for 1,062 of the total 9,910 corruption cases investigated by the CBI and pending trial at different stages in courts across the country, as on January 31, 2011.

Narayanasamy had said, "Of the 71 courts, sanction orders have, so far, been issued for 54 courts out of which 10 are already functional. The state governments have been requested to take necessary steps to make operational the remaining of the sanctioned courts."
