City survey officers surrender to consumer forum

In a significant development, two city survey officers Jitendra Bende and Kamalakar Hattekar were released on bail after furnishing personal bail bonds of Rs 50,000 each in the Nagpur District Consumer Forum regarding criminal proceedings initiated by it under Section 27 of the Consumer Protection Act, 1986.


In execution proceedings filed by the complainants -- Tushar Mandlekar, Bhagwat Ramde, Kishore Dahikar and Kamlabai Aphale -- against these officers, it was alleged that they had willfully disobeyed the judgment of forum comprising chairman Vijaysingh Rane and member Milind Kedar delivered on November 9 last year. The forum had directed the respondents to make mutation of the complainants and also pay Rs 1,000 as compensation towards causing harassment and mental agony to them within a month. Mandlekar and Vishwas Bagaddeo were counsels for the complainants.


After the complaints were filed under Section 12 of the Act, the forum members ruled that since the city survey officers had failed to record the mutation of their properties in 30 days as per rule after accepting the fees of Rs 5, they committed unfair trade practice and deficiency in service.


In their execution proceedings, the complainants claimed that the accused officers had not complied with the forum's order which amounted to an offence under Section 27 of the Act. They had prayed for maximum imprisonment of three years along with the fine of Rs 10,000 each in criminal proceeding.


The members accepted the complainants' application and issued summons to the officers after which they surrendered before the forum and secured a bail. They were warned their failure to attend the forum proceedings would result in forfeiture of the amount of bail through their salaries. Legal experts believed that the stern stand taken by the forum will increase the respect for its rulings among the government officers.
